Kangaroo Court: Justice Binta moves to try Kanu under Sharia Law, Dumps Nigerian secular law

Nnamdi Kanu and others arriving at the Federal high court Abuja on Monday, March 20, 2017

The secularity of the Nigerian Criminal law has been cast overboard as Justice Binta Nyako opted for the Islamic legal code, the Sharia for the trial of the leader of the Indigenous People of Biafra (IPOB).

This is following the defence counsel's application on variation of Justice Binta's order on shielding of witnesses.

In his argument, Kanu's lawyer, Ifeanyi Ejiofor contented that "an order of the court is law", stressing the need to obey Justice Binta's order on same case.

Responding, Justice Nyako stated that nothing will change her order on the issue of masked witnesses, adding that if the defence counsel had studied sharia law in school, he would've learned more about masked witnesses and that a woman’s identity is protected in court in the context of the Sharia Law.

However, this is interpreted to mean that Nnamdi Kanu, a Christian would no more be tried under the Nigerian secular law which is recognized by the Nigerian constitution but by sharia, because it is only on the context of sharia law that the masking of witnesses can be justified.

The judge adjourned till April 6, 2017 for the review of the order on witness protection and April 25, 2017 for ruling on the bail applications.

On this basis, we therefore solicit the attention of global Human Rights organizations to use their good offices to step into this crying injustice being perpetrated by the Abuja regime in Nigeria.
